Quick Take #5: Don’t put JMP (or yourself) at risk
In the latest Quick Take, CEO Jon Weisz (@Jon_Weisz) sits down with Senior Legal Counsel Sheila Spence (@SheilaSpence) to discuss a critical topic for anyone in a customer-facing role: navigating non-disclosure agreements (NDAs) and safeguarding data privacy.
When a customer or prospect asks us to sign an NDA, the instinct is often to just sign it and keep the deal moving. But as Spence explains, that quick signature can actually introduce unexpected risks, both for JMP and for you personally.
Watch the full video to learn:
- Why we rarely need to sign customer NDAs, and how our Universal Terms Order Form (UTOF) already has us covered.
- The steps to take and whose approval you need if a new prospect requests an NDA before a contract is in place.
- What you should (and shouldn't) do when a customer's front-desk security asks you to sign a liability waiver just to enter the building.
- Best practices for when a customer wants to share a real data set to troubleshoot a support issue.
Starting Thursday, July 9, JMP is implementing new restrictions around exporting personally identifiable information (PII) directly from Salesforce. Watch as Weisz and Spence explain what this means for your workflow and how you can still access the data you need.

As a sales manager I would advise my sellers that if a prospective customer requires an NDA, please push them to consider buying a subscription. It is a low-cost barrier to be fully covered by confidentiality (Section 10 in the subscription terms). The cost of the subscription is less than having both parties go through NDA negotiation, which could surely prolong your sales cycle.
Re: Quick Take #5: Don’t put JMP (or yourself) at riskThanks, @SheilaSpence for this great explanation of our data privacy practices!
To add some additional detail from a systems perspective, Salesforce will not allow an email to be sent to a lead or contact who is marked as opt-out. Also, for larger email blasts through Hubspot, that system does not synch over any leads or contacts who have opted out and will not include them in any blasts. Finally, to ensure that we comply with a data subject's email preferences, any mass emails to customers or prospects should only be sent through these two systems.
Re: Quick Take #5: Don’t put JMP (or yourself) at riskThis was extremely helpful, especially (from the SE perspective) the questions around customers wanting to share data or having to sign waivers or agreements on customer locations.
Re: Quick Take #5: Don’t put JMP (or yourself) at riskThank you for making this video! I did have a quick question for clarification @SheilaSpence - Regarding the "opt in" requirement, where you noted a customer must have opted into our communications for us to email them - can you clarify if this applies to 1:1 email communications between a salesperson and a customer, or only to broader marketing communications?
Re: Quick Take #5: Don’t put JMP (or yourself) at riskLove this!
